Terms and Conditions
The terms governing your use of the Petition the Majority platform, including our SMS messaging program.
Petition the Majority (the "Platform") is operated by Petition the Majority App LLC ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Platform, including our website, our SMS messaging program, and our email communications.
By creating an account, joining an organizer's network, or otherwise using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Platform.
Petition the Majority is a civic engagement platform that helps individuals organize their personal networks to take coordinated action on congressional issues. There are two kinds of participants:
- Organizers (Senders): registered users who build a network of contacts and send civic engagement campaigns to that network
- Contacts: individuals who choose to join an organizer's network through that organizer's personal join page
The Platform matches each contact to their congressional district and elected officials based on the ZIP code or address they provide, and delivers campaign messages by email and, where separately consented to, by SMS.
- You must be at least 18 years old and a resident of the United States to use the Platform
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activity that occurs under your account
- You must provide accurate information and keep it current
- You may only provide a phone number or email address that belongs to you, or that you have direct, documented permission to provide
These terms apply to the Petition the Majority SMS program, operated by Petition the Majority App LLC. SMS messages are sent by Petition the Majority App LLC on behalf of the individual organizer whose network you joined.
How to Opt In
Opting in to SMS is a two-step process. First, you visit an organizer's public join page (for example, petitionthemajority.com/join/bernard), enter your phone number, and check an unchecked consent box that reads:
“I agree to receive SMS messages from Petition the Majority on behalf of [Organizer Name] about civic engagement campaigns. Msg & data rates may apply. Reply STOP to cancel.”
Second, you will receive a single confirmation text. You must reply YES (or another opt-in keyword listed below) to complete the double opt-in. No campaign messages are sent until you confirm. If you never reply, you never receive messages.
SMS consent is optional. It is not required to join an organizer's network, and it is not a condition of purchasing any goods or services.
Program Description
Once confirmed, you will receive SMS notifications when an organizer in whose network you belong publishes a civic engagement campaign. Each message identifies the organizer and includes a link to view the full message on our website and to contact your elected representatives.
Message Frequency
Message frequency varies. Messages are sent on an as-needed basis when an organizer in your network publishes a campaign, and depend on that organizer's activity.
Cost
Message and data rates may apply. Petition the Majority does not charge for the SMS program, but standard messaging and data rates from your wireless carrier apply to all messages sent and received. Please check with your carrier for details of your messaging plan.
Opt-In Keywords
Reply START, YES, UNSTOP, AGREE, OK, or Y to opt in or to resume messages after opting out.
How to Opt Out
You can cancel at any time by replying STOP, NO, UNSUBSCRIBE, CANCEL, END, or QUIT to any message from us. After you send one of these keywords, we will send a single confirmation message and then send no further SMS messages. You may also ask the organizer to remove you from their network, or contact us using the details below.
Help
Reply HELP to any message for assistance, or contact us using the details at the bottom of this page.
Carriers and Delivery
Wireless carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your wireless carrier and is not guaranteed. The program is supported by major U.S. carriers, and carrier participation may change without notice.
Your Mobile Information
We do not share, sell, rent, or provide your mobile phone number or your SMS consent data to third parties or affiliates for marketing or promotional purposes. Mobile opt-in and consent information is never shared with third parties for any purpose other than delivering the messages you asked for. See our Privacy Policy for full details.
Petition the Majority is not a lead generation, affiliate marketing, or list brokerage service, and the Platform may not be used for any of those purposes.
- We do not buy, sell, rent, or trade phone numbers, email addresses, or consent records
- Consent is collected directly from each contact, by that contact, on the organizer's join page, and applies only to the specific network they joined
- Contact information collected for one organizer's network is never used to message on behalf of a different organizer
- Organizers may not upload, import, or otherwise use purchased, rented, scraped, or third-party contact lists
- We do not send marketing or promotional messages on behalf of any third party
When using the Platform, you agree not to:
- Add any contact who has not given you direct permission to contact them
- Send messages that are unlawful, harassing, defamatory, deceptive, threatening, or hateful
- Send content prohibited for SMS by U.S. carriers, including messages concerning cannabis, illegal substances, firearms, hate speech, adult content, gambling, or high-risk financial offers
- Impersonate any person, organizer, elected official, or organization
- Attempt to circumvent opt-out requests or re-add a contact who has opted out
- Interfere with, probe, or attempt to gain unauthorized access to the Platform or its infrastructure
- Use the Platform in violation of the TCPA, CAN-SPAM, CTIA guidelines, or any other applicable law or carrier requirement
We may suspend or terminate any account that violates these rules, with or without notice.
Organizers are solely responsible for the contacts they add and the campaigns they send. By sending a campaign, an organizer represents that every recipient has given direct permission to be contacted, and that the content complies with these Terms and all applicable law.
Campaign and issue content reflects the views of the organizer or the author of the issue, not necessarily those of Petition the Majority App LLC. We do not endorse any candidate, party, or elected official.
The Platform, including its software, design, and branding, is owned by Petition the Majority App LLC and protected by intellectual property law. You retain ownership of the content you create, and grant us a limited license to host, display, and transmit that content solely in order to operate the Platform on your behalf.
The Platform is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error free, or that district and elected official data will always be accurate or current.
To the maximum extent permitted by law, Petition the Majority App LLC is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of your use of the Platform. Our total liability for any claim relating to the Platform is limited to one hundred U.S. dollars ($100).
You agree to indemnify and hold harmless Petition the Majority App LLC and its officers, members, and agents from any claim, damage, or expense (including reasonable attorneys' fees) arising out of your use of the Platform, the contacts you add, the content you send, or your violation of these Terms or any applicable law.
You may stop using the Platform at any time and request deletion of your account. We may suspend or terminate access if you violate these Terms, if required by law or a carrier, or if we discontinue the Platform. Sections concerning intellectual property, disclaimers, limitation of liability, and indemnification survive termination.
These Terms are governed by the laws of the District of Columbia, without regard to its conflict of law rules. Any dispute arising out of these Terms or the Platform will be brought exclusively in the state or federal courts located in the District of Columbia.
We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date below and, where required, notify you through the Platform. Your continued use after changes are posted constitutes acceptance of the updated Terms.
For questions about these Terms, our SMS program, or to request account removal, contact us through the Petition the Majority platform or reach out to your campaign organizer directly.
